Terms & Conditions

These Terms and Conditions of Hire govern the relationship between you and us and your signature of the order form on the front of these Terms and Conditions indicates your acceptance of them. Only place an order with us if you agree to be bound by these Terms and Conditions.  In no event will this hire agreement cover a period in excess of 3 months.

 WHAT WE WILL PROVIDE:

1.      HIRE OF GARMENTS

1.1    We will hire to you the garments detailed on your order form as long as they are within the size range available. Please note that it is not possible to carry out alterations to garments as you might expect if you had purchased them.

1.2    All garments are quality checked and processed after each hire and every effort is made to ensure the quality is to high standard and that garments are free from any defects when collected by you. However, due to dry-cleaning there may be a slight shading difference in garments, especially where garments are ordered for a large wedding party.

1.3    We reserve the right to substitute to the nearest half size as follows:

a) Jacket size +2 inch

b) Trouser Length +or – 1 inch

c) Trouser waist +2 inch

d) Top hat size +1/8

e) Shoes +1/2 size

f) Shirts +1/2 inch

WHAT WE EXPECT OF YOU:

2.      BOOKING

2.1    You must be measured at the store of collection (as identified on the order form overleaf), otherwise no responsibility will be taken for discrepancies. (It is your responsibility to check that all the details on the order form (e.g. function date, garments etc,) are correct.

2.2    The hire period is deemed to start from 9am on the Function Date. If hires are required earlier than the normal Fitting Date an additional charge of 50% per week or part week is payable.

3.      DEPOSIT

3.1    A minimum deposit of 50%  of the total hire charge must be paid on placing the order.

4.      CHANGES TO ORIGINAL ORDER

4.1    We reserve the right to charge you £2 per garment for any change you request against your original order, unless due to condition 5.5 below and such charges will be added to the total hire charge and payable upon collection of the garments.

5.      FITTING

5.1    You must call the store of collection to confirm that your order is in the store and that there have been no unforeseen delays in delivery of your order prior to you travelling to the store for any fitting appointments. You must attend the store of collection on the Fitting Date and try on all garments to ensure they fit.

5.2    If the fit is not satisfactory you must report this to us immediately or not later than 12 noon the day following the Fitting Date. If you do not report that a garment does not fi t satisfactory and request a replacement item with this time we cannot guarantee that such replacement item can be delivered in time for your Function Date. If we are able to deliver such replacement item additional charges will be charged payment of which will be your responsibility. Any additional charges will be added to the sums set out on the order form overleaf and will been payable upon collection.

5.3    If garments do not fit satisfactory or have any other fault visits to the store of collection will be necessary .All replacements must be inspected and tried on by you (or other members of you party if applicable) at the store of collection. Goods will be delivered only to the store of collection as identified in your original order for checking and trying on by you (and the other members of your party if applicable).

5.4    You will be responsible for and we shall have no liability for you own expenses (e.g. travel costs, time off work, etc.)Incurred during this fitting and collection process-even if the garment has a fault.

5.5    As children’s sizes change quite significantly whilst they are growing you should arrange to re-measure any children for whom you are hiring garments 4 weeks prior to the Function Date to confirm the sizes required. This allows plenty of time to amend the order if necessary .It is not uncommon for children’s garments to need several fittings.

5.6    We will have no liability for any costs expenses losses or damages incurred or suffered by you or for timely delivery of the hired garments as a result of your failure to comply with any of the above requirements in this section 5.

6.      CANCELLATION OF ORDER

6.1    In the event of an order being cancelled within 48 hours of the Order Date the deposit will be refunded in full unless condition 6.3 below applies

6.2    In the event of an order being cancelled more than the 48 hour after the Order Date the deposit will be non-refundable.

6.3    In the event of the order being cancelled within one week before the Fitting Date you will be required to pay the total hire charge for each garment ordered.

7.      GROUP BOOKINGS

7.1    As the individual who signs the order form, if you are hiring garments for more than one individual you will procure the compliance with these Terms and Conditions of the Hire by all other members of you party and you will indemnify us and keep us indentified in full for any costs expenses losses or damages incurred or suffered by us as a result of any failure by any member of your party to comply with these Terms and Conditions of Hire.

8.      COLLECTION OF GARMENTS

8.1    You must call the store of collection to confirm that your order is in the store and there have been no unforeseen delays in delivery of your order prior to you travelling to the store for collection.

We will not be liable for any costs expenses losses or damages incurred or suffered by you which could have been avoided if you had complied with this requirement. When you have had fittings and any necessary replacements have also been tried on and found to be satisfactory the outfits is then deemed to be available for collection.

8.2    You must inform the store of collection, when placing your order, if the outfits are required before the Function Date and it is your responsibility to ensure that this is stated on your order form. We will not be liable for any collection of garments before the Function Date unless this is stated on your order form overleaf.

8.3    Any failure to collect the garments will be deemed to be cancellation in accordance with the condition 6.3 and accordingly you will be charged the total hire charge for each garment ordered.

8.4    The total hire charge is payable on the date agreed for collection of the garments as set out on the order form overleaf.

9.      EXTENDED HIRE – (BEFORE OR AFTER THE FUNCTION DATE)

9.1    Hire orders may be extended for additional weeks at a rate of 50% of the normal weekly hire charge for additional or part week subject to a maximum of 3 months. This includes provision of for the delivery of orders earlier than the normal delivery date applicable to the store of collection.

10.    LATE ORDERS

10.1        Late orders will be any order placed less than 3 weeks prior to the function date. Late orders may be accepted at the discretion of the store of collection but we cannot guarantee that garments that are the subject of a late order can be delivered in time for your Function Date. If we are able to deliver such late orders additional carriage charges will be charged payment of which will be your responsibility and will be due upon collection.

11.    RETURN OF GARMENTS

11.1       You are responsible for the safe return of all hired garments in an undamaged condition. You will indemnify us and keep us indentified against any loss or damage to the garments during the period they are hired to you and/or any failure to return any garment bags or hat boxes.

11.2        All garments must be returned by the Return Date stated on the order form overleaf. Failure to do so will result in an excess charge of £8 per suit per day after the stated Return Date and failure to return any garment bag or hat box will incur a charge of £8 for each item. All charges for late return will be payable by you within 7 days of the scheduled return date. There is no exception this condition.

11.3       If you fail to return any hired garments we will pursue the return of all garments and all monies owing.

12.    CARE OF GARMENTS

12.1        Please treat the garments with reasonable care.

12.2        Please take particular care with top hats. Under no circumstances should they be thrown in the air.

13.    ACCIDENTAL DAMAGE WAIVER

13.1        Payment of Accidental Damage Waiver (ADW) by you covers any charges that would normally arise following accidental damage to any or all of the garments provided that they were being used appropriately (with the exception of top hats, which are NOT covered by the ADW).

13.2        ADW does not cover garments which have in our opinion been damaged through inappropriate use and lost or stolen garments.

13.3        Please remember that any personal insurance you may already hold does not cover the garments owned by us.

13.4        We reserve the right to charge you for and you will be responsible for the replacement cost of any garment which is lost stolen or returned damaged (unless covered by our ADW). A full list of charges is available on request.

14.    LIMITATION OF LIABILITY

14.1        We will not be liable for any loss of profits, any indirect and/or consequential losses.

14.2        In any event our liability is limited to the full hire cost of the order in connection with which any claim or potential claim relates.

15.    DATA PROTECTION ACT 1998

15.1        Under the Data Protection Act 1998, we have a legal duty to protect any personal information we collect from you and we will take all necessary steps to comply with the Data Protection Act 1998 and its relevant subordinate legislation when handling any personal data which you may provide us.

15.2        We will collect personal information from you in order to provide you with the products and services you request from us and will use the personal information you supply us for this purpose.

15.3        We will hold your information for as long as necessary to fulfil that purpose.

15.4        We would also like to use your information to let you know about services offered by us that we think may be of interest to you and may hold your information for a reasonable period of time for this purpose. You will only receive this type of information if you have either confirmed to us that you are happy to receive this type of information and/or you have not informed us that you do not wish to receive it. 15.5        We will only pass your personal information to third parties.

15.5.1 Who work with us or on our behalf to provide a product or service to you which you have requested and such persons may only use this information in order to provide such product or service and not for any other purpose

15.5.2 Who work with us or on our behalf to provide services to us for example in respect of customer analysis and marketing if you have agreed to our use of your personal information for this purpose; and

15.5.3 Where we are required to forward the information or data in order to comply with any regulatory or legal process.

15.6        In addition to condition 15.5, we may assign our right to recover payment for any or all charges (including charges payable in connection with any damaged, missing, late or unreturned item) payable by you under your order to Ultimate Hire (or such other third party as we may determine from time to time) Where we so assign our right to recover payment, you acknowledge and agree that we may pass your personal details (including your credit card details) to Ultimate Hire (or such other third party as we may appoint from time to time) for the purpose of processing and collecting such charges. You further acknowledge and agree that Ultimate Hire (or such other third party so appointed by us) may hold any such personal details that we pass to them until such time as you return to Ultimate Hire all the garments and accessories hired by you from us, as set out in your order.
